The swimming pool sector is yes very small in terms of turnover and impact from an economic point of view, if we exclude the impact on users, but it is very large in terms of the complexity of topics on which it goes to affect. Starting from urban planning, to design, to construction in all its possibilities, to the plant engineering part, to management. The &#8220;swimming pool&#8221; topic crosses across an innumerable amount of sectors and aspects, but to bring them all together under a single legislative provision at the national level is still not talked about. Thus, we are forced to navigate, using terms of water and wind, in an unknown sea, in which the waves change in intensity and direction, and the possibility of shipwreck is always just around the corner. But as long as things stay this way, this is how it will always be.<\/p>\n\n<p class=\"wp-block-paragraph\">However, we attempt to give some useful indications on the legislative situation and possible interpretations for the types of swimming pools we are interested in. For the hygienic-sanitary aspect, the most important provision is the &#8220;Agreement between the Minister of Health, the regions and the autonomous provinces of Trento and Bolzano on the hygienic-sanitary aspects for the construction, maintenance and supervision of swimming pools for swimming use,&#8221; published exactly twenty years ago, in 2003. It is a kind of container in which all regions were supposed to find the general guidelines to independently prepare their own regional laws. This was not the case, because although all the regions except Sicily published a resolution transposing the Agreement, only a little more than half of them have proceeded to enact a specific regional law.<\/p>\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/www.professioneacqua.it\/wp-content\/uploads\/2022\/07\/Accordo-Stato-Regioni-2003.pdf\" target=\"_blank\" rel=\"noopener\">Text of the Agreement<\/a><\/li><li><a href=\"https:\/\/www.professioneacqua.it\/leggi-regionali-per-le-piscine\/\" target=\"_blank\" rel=\"noopener\">Local laws<\/a><\/li><\/ul>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\"> <\/p>\n\n<p class=\"wp-block-paragraph\">The 2023 agreement classifies swimming pools according to the type of use. The categories identified are as follows:<\/p>\n\n<ul class=\"wp-block-list\"><li>(a) Publicly or privately owned swimming pools intended for public use. This category includes the following types of swimming pools whose specific structural and management characteristics are defined by each region:<\/li><li>(a\/1) public swimming pools (such as municipal swimming pools);<\/li><li><\/li><li>(a\/2) swimming pools for collective use: these are those included in facilities already used, on a principal basis, for other accommodation activities (hotels, campsites, accommodation complexes and the like) as well as those serving communities, gyms or the like, accessible only to guests, clients, members of the facility itself;<\/li><li>(a\/3) facilities aimed at aquatic play (b) swimming pools, the legal nature of which is defined by Articles 1117 et seq. of the Civil Code, intended exclusively for the inhabitants of the condominium and their guests;<\/li><li>(c) special-use pools located within a treatment, rehabilitation, spa facility, the regulation of which is defined by specific legislation.<\/li><\/ul>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Tourist-accommodation pools, therefore, belong to the A2 category. Not all tourist-accommodation facilities, however, have been treated by the regions in the same way, especially with regard to the broad category of non-hotel.<\/p>\n\n<p class=\"wp-block-paragraph\">There are regions that exclude B&amp;Bs from the scope, some regions have simultaneously published regional resolutions on swimming pools that include swimming pools at agritourisms in the scope, and regional laws that change the rules. No region considers swimming pools serving apartments rented through short-term rentals, such as Air B&amp;B. When dealing with the non-hotel sector, therefore, caution and timely verification of the regional rule, assuming it exists, is necessary.<\/p>\n\n<p class=\"wp-block-paragraph\">As for bathing establishments and campgrounds, however, the situation is clear: swimming pools belong to category A2. Associated with the category are requirements, which vary, unfortunately, depending on the region. They are the same throughout Italy, however, with regard to the technical standards, which classify this type of pool as Type2 of pools for public use.<\/p>\n\n<p class=\"wp-block-paragraph\">Beware of possible overlaps in pool use: when a pool built as A2 is made available to an undifferentiated public, it becomes category A1 and the requirements are more stringent, starting with the need for the presence of a lifeguard. This can happen, for example, for a hotel pool that is made available to anyone who pays a fee.<\/p>\n\n<p class=\"wp-block-paragraph\">But is the pool of a bathing establishment A1 or A2 category? This is a legitimate question, dictated by the fact that anyone paying for an umbrella can access the pool, so there is, upstream, no customer selection. It is also true, however, that this concept applies to any tourist facility, think of a hotel where the customer stays only one night.<\/p>\n\n<p class=\"wp-block-paragraph\">The diriment concept to differentiate A2 facilities from A1 facilities is the &#8220;filter&#8221; constituted by the main object of the service offered, which is not the swimming pool. The pool can be used as one is a &#8220;guest, customer, member of the facility itself.&#8221; If, on the other hand, one pays a ticket only for access to the swimming pool, then there are no filters, the object of the service becomes the swimming pool, and the category changes from A2 to A1, with all the appropriate consequences.
